On the Approval of the Safety Rules for Water Bodies

In accordance with subparagraph 70-4) of paragraph 1 of Article 12 of the Law of the Republic of Kazakhstan of 11 April 2014 "On Civil Protection", I ORDER:
      1. To approve the attached Safety Rules on water bodies.
      2. To the Committee for Emergency Situations of the Ministry of Internal Affairs of the Republic of Kazakhstan (Petrov VV) in accordance with the procedure established by law to ensure:
      1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
      2) within ten calendar days after the state registration of this order, its direction for official publication in periodicals and in the information and legal system "Adilet";
      3) placing this order on the Internet resource of the Ministry of Internal Affairs of the Republic of Kazakhstan.
      3. Control over the execution of this order shall be entrusted to Deputy Minister of Internal Affairs of the Republic of Kazakhstan Bozhko V.K.
      4. This order is put into effect after 10 calendar days after the day of its first official publication.

1. General Provisions
      1. These Safety Rules on water bodies (hereinafter - the Rules) determine the procedure for ensuring the safety of citizens when using water bodies of the Republic of Kazakhstan.
      2. The following terms are used in these Rules:
      1) water bodies - rivers and equated channels, lakes, reservoirs, ponds and other inland water bodies, territorial waters;
      2) rescue post - a post in a certain area of ​​the water area, equipped with lifeguards, equipped with rescue equipment, performing functions to ensure the safety of people in water bodies and created by legal and physical persons;
      3) resting place on the pond - an equipped place for swimming (beaches), rolling stations for boats, yachts, boats, jet skis and catamarans;
      4) small craft - the ship is not more than 20 meters in length with an acceptable number of people on board no more than 12 people, in addition to built or equipped for fishing, cargo transportation, towing, holding prospecting, exploration and mining, construction, travel, hydraulic, and other similar works, pilotage and icebreaking, as well as the implementation of measures to protect water bodies from pollution and clogging;
      5) rescue "End-Alexandrov" - a means to help the drowning, which is a floating line about 30 meters in length with a loop with a diameter of 40 centimeters and two floats;
      6) the training place is a specially equipped place on the beach that is maximally adapted for conducting collective and individual swimming lessons;
      7) city beach - a place of rest on the pond, which is under the jurisdiction of the local executive body;
      8) an individual rescue device is a life-saving device intended to create additional buoyancy to a person while in water or on ice. Individual life-saving appliances include lifebuoys, vests, bibs, buoys;
      9) holiday-makers - persons on the water for rest, fishing, bathing, skating on small boats and other recreational activities that are responsible for compliance with the requirements of these Regulations;
      10) responsible for compliance with the requirements of these Rules - owners of water bodies, instructors (trainers), rescuers, local executive bodies, as well as persons using reservoirs.

      3. Designated public recreation, tourism and sports on water bodies and water facilities established by local executive bodies of area (city of republican status, capital) as agreed with the authorized body in the sphere of use and protection of water resources, water supply and sanitation, the authorized state body in the field of environmental protection, the authorized body in the field of sanitary and epidemiological welfare of the population in compliance with environmental requirements and safety human life.
      4. Local representative bodies of oblasts (city of republican status, capital) in order to protect the life and health of citizens, taking into account regional peculiarities provided in accordance with the Water Code of the Republic of Kazakhstan from July 9, 2003 № 481 specifies where prohibited bathing, water withdrawals for drinking and domestic needs, watering cattle, using skating on small boats and other floating facilities on water bodies located in the territory of the respective region.
